Welcome to obsidianfirewalking.com. The obsidianfirewalking.com website (the “Site”) is comprised of various web pages operated by Obsidian Firewalking LLC (“Obsidian Firewalking”). obsidianfirewalking.com is offered to you conditioned on your acceptance without modification of the terms, conditions, and notices contained herein (the “Terms”). Your use of obsidianfirewalking.com constitutes your agreement to all such Terms. Please read these Terms carefully, and keep a copy for your records.

Electronic Communications

Visiting obsidianfirewalking.com or sending emails to Obsidian Firewalking constitutes electronic communications. Obsidian Firewalking is not responsible for third-party access to your account resulting from theft or misappropriation. We reserve the right to refuse or cancel service, terminate accounts, or remove or edit content at our sole discretion.

Children Under Thirteen

Obsidian Firewalking does not knowingly collect personal information from children under 13. If you are under 18, you may use obsidianfirewalking.com only with permission of a parent or guardian.

Cancellation / Refund Policy

Individual cancellations

Full payment is required at the time of registration to secure your place at an Obsidian Firewalking event. Registrations without full payment are considered “enrolled” only and do not guarantee participation, lodging, meals, program access, or entry to the event property.

All cancellation notices and refund requests must be submitted in writing to Obsidian Firewalking prior to the start date of the event. Refund eligibility:

• 30+ days before arrival: All payments refunded, minus a $35 per person administrative fee.
• 29 to 1 day before arrival: All payments refunded, minus a $60 per person administrative fee.
• No notice / No-Show: No refund will be issued.

Links to Third-Party Sites / Services

The Site may contain links to other websites (“Linked Sites”). Linked Sites are not under the control of Obsidian Firewalking and we are not responsible for their contents or changes/updates. Links are provided as a convenience and do not imply endorsement.

Third-Party Services

Certain services available via obsidianfirewalking.com are delivered by third parties. By using any product, service, or functionality originating from obsidianfirewalking.com, you acknowledge and consent that Obsidian Firewalking may share information and data with third parties with whom we have contractual relationships to provide the requested product, service, or functionality.

No Unlawful or Prohibited Use / Intellectual Property

You are granted a non-exclusive, non-transferable, revocable license to access and use the Site strictly in accordance with these Terms. You agree not to use the Site for any purpose that is unlawful or prohibited by these Terms and not to interfere with other users’ enjoyment of the Site. All content on the Site is the property of Obsidian Firewalking or its suppliers and is protected by applicable laws. You agree not to modify, publish, transmit, reverse engineer, sell, create derivative works from, or exploit any content without express written permission.

International Users

The Service is controlled and administered by Obsidian Firewalking from our offices within the USA. If you access the Service from outside the USA, you are responsible for compliance with local laws.

Indemnification

You agree to indemnify, defend, and hold harmless Obsidian Firewalking, its officers, directors, employees, agents, and third parties from losses, costs, liabilities, and expenses (including reasonable attorneys’ fees) relating to or arising out of your use of the Site/services, your postings, your violation of these Terms, your violation of any rights of a third party, or your violation of applicable laws, rules, or regulations.

Arbitration

If disputes cannot be resolved, they will be settled by final and binding arbitration under the Federal Arbitration Act, conducted by a single neutral arbitrator and administered by the American Arbitration Association (or similar service) at a mutually agreed location. The arbitrator’s award shall be final and may be entered in any court with jurisdiction.

Class Action Waiver

Any arbitration will take place on an individual basis; class arbitrations and class/representative/collective actions are not permitted. You may bring claims only in your individual capacity.

Liability Disclaimer

The information, software, products, and services on the Site may include inaccuracies or typographical errors. Changes are added periodically. To the maximum extent permitted by law, the Site and all content are provided “as is” without warranty of any kind. Obsidian Firewalking disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. To the maximum extent permitted by law, Obsidian Firewalking shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data or profits, arising out of or in connection with the Site or services.

Termination / Access Restriction

We may terminate your access to the Site or services at any time, without notice, in our sole discretion. This agreement is governed by the laws of the State of North Carolina; you consent to the exclusive jurisdiction and venue of courts in North Carolina.

Entire Agreement; English Language

Unless otherwise specified, this agreement constitutes the entire agreement between you and Obsidian Firewalking regarding the Site and supersedes all prior communications, whether electronic, oral, or written. A printed version of this agreement and any notice given in electronic form shall be admissible in judicial or administrative proceedings to the same extent as other business documents and records originally generated and maintained in printed form. It is the express wish of the parties that this agreement and all related documents be written in English.
